Matrimonial Law
Larry McCord and Associates specializes in matrimonial
law-particularly divorce matters. The grounds for a divorce in New York
are: adultery, cruel and inhuman treatment, abandonment for more than
one year, incarceration for more than three consecutive years, and
living separate or apart for more than two years under a separation
agreement. Unlike other states, New York does not permit a divorce based
upon incompatibility.
In most cases when the issue is raised, marital property
is equally distributed between both parties when a judgement of divorce
is granted. The marital property consists of all assets that were
brought into the marriage up until the divorce action has been
commenced. Marriage is an economic partnership. Therefore, when either
party decides to file for divorce, the assets should be distributed
fairly. Marital property does not include assets such as inheritance,
gifts from persons outside of the marriage and personal injury
compensation. The burden of proof rests with the party who claims that
the asset is separate property.
Think of a divorce like a college course. Before you are
eligible to take the classes of your choice there are always
prerequisites. Well, there are prerequisites in a divorce as well. In
order for a court to grant your divorce, both parties have an
opportunity to make a decision on the distribution of the property. If
the divorce is denied, there will be no other relief. In order for the
Court to grant a divorce, the parties must either settle on the
distribution of the marital assets or the issue will be decided by the
Court.

privacy as to school supplied lockers. However, contrary to popular
belief students have the right to have their parent present if they are

right to be free from unreasonable searches and seizures.
